Terms and conditions for using DMS Smart Monitor services.

1. Agreement to Terms
By accessing or using DMS Smart Monitor services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.
"You" refers to the individual or organisation accessing the Services. "We", "us", and "our" refer to Damp and Mould Ltd.
2. Description of Services
DMS provides environmental monitoring services including hardware sensors, data collection, cloud storage, dashboards, alerts, and reporting. Specific features depend on your subscription tier.
3. Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining account security and for all activities under your account. Notify us immediately of any unauthorised access.
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to gain unauthorised access to our systems
- Interfere with or disrupt the Services
- Reverse engineer or attempt to extract source code
- Resell or redistribute the Services without authorisation
5. Hardware and Installation
Hardware purchased remains your property after payment. You are responsible for proper installation (following our guidelines) or may engage our installation services. Improper installation may void warranties and affect data accuracy.
6. Subscription and Payment
Subscription fees are billed in advance on a monthly or annual basis. Prices may change with 30 days' notice. Non-payment may result in service suspension. Refunds are provided in accordance with our Refund Policy.
7. Data Ownership
You retain ownership of your data. You grant us a license to process, store, and transmit your data as necessary to provide the Services. We may use anonymised, aggregated data for service improvement and research.
8. Service Level
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. Enterprise customers may have specific SLA terms.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that monitoring will prevent all damp, mould, or water damage. Environmental monitoring supports but does not replace professional building inspection or maintenance.
DMS does not provide legal, medical, or building surveying advice. Compliance decisions remain your responsibility.
10. Limitation of Liability
To the maximum extent permitted by law, our liability is limited to the fees you have paid in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages.
11. Indemnification
You agree to indemnify us against claims arising from your use of the Services, your breach of these Terms, or your violation of any third-party rights.
12. Termination
Either party may terminate with 30 days' written notice. We may suspend or terminate immediately for breach of these Terms. Upon termination, you may export your data for 30 days, after which it may be deleted.
13. Changes to Terms
We may modify these Terms with notice. Continued use after changes constitutes acceptance. Material changes will be communicated via email.
14. Governing Law
These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
